Modern Criminal Laws

 

 



New criminal laws have been made and theirimpacts are to be studied. These have been enforced o

on July 1.

 These laws are modified to fight modern day crimes. Any electronic media will be considered as a document 
of proof. Earlier only Email was considered as an evidence. But now all electronic devices will be under suspect
 to be instrument of crime . Nowadays crimes are executed via use of social media. It's a trend for parents to create
 a social media account for a newborn. It is far too easy for a child to escape the warnings by faking their age. 
Everyone is aware of the restriction to be less than 18. There is a lot of negativity. Youngsters are getting exposed 
to vulgarity and nudity. This causes a lot of crimes to be catalyzed. 
The three new criminal laws in 2024 are Bhartiya Nyay Sanhita, Bhartiya Nagrik Suraksha Sanhita and 
Bharatiya Saksha Adhiniyam . Laws have been enacted to match the modern crimes committed by use of 
technology and new advancements. Deepfake and AI are a challenging technology.Earlier Bhartiya Nyay Samiti
(BNS) was known as Indian Penal Code as enacted by Britishers.One can call on a CUG number anytime 24*7 to 
register a case. On the first day itself a lot of cases have been reported.
There is a change in section 69 and coitus on ground of false promise of marriage will be considered crime . There 
are provisions of knowing each other's history in case of live in relationship. There are different cause and effect
 in such cases.
Experts have different views. Senior Judge, Sumit Gehlot says that these laws have been launched in a haste and no 
proper discussion was done. Sedition law under section 150 was converted to a draconian one. It is converted to 
treason trial and police now has the power to extend the trial from 15 to 90 days. This is definitely a political move. 
He also stated that this law of terrorism has been mentioned in special sections and it shall not be included in 
these penal section. He is seriously apprehensive of the laws.
 
As per Chief Justice of India,Higher courts have suggested lower courts to handle petty cases and speed up 
jurisdiction process.A judge, NS Nannamai said that these laws will see a lot of petitions and discussions. 
She is hopeful about the future. Justice Aishwarya Kaushik also said that these laws have been launched in a 
haste and without much discussions. There is definitely a lot of pending arguments to be heard on these.
These matters involving laws are part of concurrent list. Many states are not ready to enforce these laws yet.
Another female lawyer said that these laws are a reality and they are gonna stay. We must update ourselves as per
 the laws to meet the requirements.Government repeated that these laws are updated to remove the influence of 
colonial laws and bring updation with latest environment.
